Privacy Policy (GDPR)

D igivantaLab, registered at 27777 Elmeloher Straße 74 A, Ganderkesee Ortsteil Elmeloh, Germany ("we", "us", "our"), is committed to protecting the privacy and personal data of all website visitors, clients, and business partners in strict compliance with Regulation (EU) 2016/679, the General Data Protection Regulation ("GDPR").

We collect personal data — including but not limited to names, email addresses, phone numbers, and business entity information — exclusively for the purposes of responding to project inquiries, delivering contracted digital services, maintaining ongoing client communications, and fulfilling statutory tax and accounting obligations.

Personal data is processed on the lawful bases of contract performance (Article 6(1)(b) GDPR), legitimate interest in client communication and service improvement (Article 6(1)(f) GDPR), and where applicable, explicit consent (Article 6(1)(a) GDPR).

We do not sell, rent, lease, or distribute personal data to unauthorized third-party data brokers. Personal data may be shared with essential technical service providers — including cloud infrastructure hosts and payment processors — strictly under data processing agreements that ensure GDPR-equivalent protections.

All personal data is stored within encrypted, EU-hosted cloud infrastructure compliant with ISO/IEC 27001 information security standards. Data retention periods are limited to the duration necessary for the stated processing purposes or as required by applicable German and EU statutory retention laws.

Under the GDPR, you have the right to access (Article 15), rectify (Article 16), erase (Article 17), restrict processing (Article 18), data portability (Article 20), and object to processing (Article 21) of your personal data. You may exercise these rights at any time by contacting us at [email protected].

You also have the right to lodge a complaint with the competent supervisory authority — the Landesbeauftragte für den Datenschutz Niedersachsen (Lower Saxony Data Protection Authority) — if you believe your data protection rights have been infringed.

Terms of Service

A ll digital services, software deliverables, and technical advisory packages provided by DigivantaLab are governed by explicitly contracted Statements of Work ("SOW") executed between the Client and DigivantaLab.

Each SOW defines the precise scope of work, deliverable specifications, milestone schedules, payment terms, and acceptance criteria for the engagement. No binding obligation arises until a signed SOW has been countersigned by both parties and the initial deposit has been received.

Upon complete settlement of all agreed commercial invoices, DigivantaLab irrevocably assigns all worldwide intellectual property rights in the client-specific software deliverables, design assets, configuration files, and digital documentation directly to the Client.

Payment terms are Net 14 days from invoice date unless otherwise specified in the applicable SOW. Late payments accrue interest at the statutory rate pursuant to § 288 BGB (German Civil Code). DigivantaLab reserves the right to suspend service delivery for accounts exceeding 30 days past due.

Either party may terminate a SOW with 30 days written notice for convenience. Termination for cause requires written notice specifying the material breach and allowing 14 days for remediation. Upon termination, the Client retains full intellectual property rights in all completed deliverables and is invoiced proportionally for work completed to date.

DigivantaLab shall not be liable for indirect, incidental, or consequential damages exceeding the total fees paid under the applicable SOW in the twelve months preceding the claim. Force majeure events — including but not limited to natural disasters, pandemics, government actions, and critical infrastructure failures — excuse performance delays without liability.

D igivantaLab is committed to fair and transparent commercial practices. This refund policy governs all refunds and reimbursements for digital services delivered under signed Statements of Work ("SOW").

Deposit Refunds: Initial deposits paid upon SOW execution are refundable in full if DigivantaLab has not commenced work within 14 calendar days of deposit receipt. Once work has commenced, deposit refunds are issued on a prorated basis minus any third-party costs already incurred.

Milestone-Based Refunds: For milestone-based engagements, any completed and accepted milestone is non-refundable. Pending, unstarted milestones may be cancelled and refunded in full with 30 days written notice. Partially completed milestones are eligible for prorated refund based on documented completion percentage.

If DigivantaLab is unable to remediate the material deficiency within this period, the Client is entitled to a partial or full refund of the fees paid for the non-conforming deliverable, at DigivantaLab's discretion.

Refund Processing: All approved refunds are processed within 14 business days to the original payment method. Refund requests must be submitted in writing to [email protected] with a clear description of the grounds for the refund request.
